Compliance: The friend you can’t afford to ghost

Let’s be honest: talking about “compliance” doesn’t exactly get people excited or enthused.  It’s the recruitment world equivalent of the sensible friend; you know, the one reminding you to bring a coat because it might rain. 
 
But the reality is that it is the one friend that keeps you out of serious trouble and makes sure you get home safe (and dry!) 

Between shifting legislation, right-to-work checks, IR35, GDPR, and sector-specific rules, compliance is the foundation that keeps agencies operating safely and reputably. If you get it wrong, it’s not just an awkward conversation, you’re looking at fines, lost clients, and damaged trust. 

So why, despite best intentions, do so many agencies still find compliance so difficult to get right?  We’ll look at all of this and how to start fixing it. 


1. The patchwork problem: Too many tools, not enough truth

Most agencies have built their processes over time, start with a CRM, add a document portal and maybe a shared drive that’s become the unofficial dumping ground for “everything important.”

Start with mapping it out. Just like you would check in with a friend to see how they are, check in with your processes. 

Where does your compliance data actually live and who’s responsible for it?  You don’t need to jump to automation straight away; just knowing where the gaps are is a game-changer. Once you’ve got the overview, then you can look at how tech can make things quicker, easier and most importantly, more reliable. 


2. “We’ve always done it that way” …

Sticking with old compliance processes is a bit like refusing to update your satnav, it still gets you there most of the time, but every so often you hit a dead end or end up going the wrong way on a new bypass. 

Recruitment moves fast, and it might feel safe and easy to stick with what’s familiar. But compliance isn’t static, regulations evolve, and what was watertight in 2018 might actually be out of step in 2025. 

An easy fix: 

Schedule quick, quarterly compliance check-ins. We’re not suggesting you reinvent the wheel each time, just a high-level review of your core processes to make sure they still align with current UK standards. 

Better yet, get people from different parts of your business involved. Compliance works best when everyone understands their part in protecting the business. 


3. Humans are brilliant (but nobody’s perfect)

People make mistakes. It’s not about effort; it’s often about capacity. Recruiters are busy, juggling a dozen jobs, chasing candidates, and managing client demands. Being on top of every expiry date, verification step, or renewal reminder simply isn’t going to happen in the real world. 

Look at automation - not to replace your team, but to support them. Build in smart alerts and reminders for all of your key milestones like document expiries, renewals, and validation checks.  Set guardrails that stop incomplete records from slipping through. 

Use technology for what it is best at (admin) and free up your people to focus on what they’re great at: building relationships with other people.  


4. Turning compliance from burden to brand strength

Here’s the thing that so many people overlook… Compliance doesn’t just protect you; it differentiates you from the competition. 

When clients see you’ve got airtight processes, they trust you more. When candidates experience a smooth, transparent onboarding journey, they stick around. Compliance, done right, actually gives a real feel-good factor, building confidence on both sides of the recruitment equation. 

How to get there: 

Start thinking about compliance as part of your customer experience. Make it simple, human, and visible. The businesses that communicate and manage compliance well are the ones winning long-term loyalty. 


5. The unsung heroes: Giving compliance people the spotlight

There’s a whole group of people in every agency who rarely get the recognition they deserve… the compliance teams. They’re the ones double-checking documents, catching inconsistencies, and quietly saving the business from risk every single day. 

But here’s the truth: if your processes are clunky or fragmented, your compliance people spend most of their time firefighting (chasing missing paperwork, updating spreadsheets, reacting to problems). It’s stressful, repetitive work that doesn’t represent their real value.
